  CONSEJERÍA DE TRANSPORTES, INFRAESTRUCTURAS Y VIVIENDA

 RESOLUCIÓN de 21 de enero de 2014, del Director General de Transportes de la Consejería de Transportes, Infraestructuras y Vivienda, por la que se procede a la publicación de las Resoluciones sancionadoras y actos administrativos de terminación anticipada en materia de transportes, que se relacionan en el Anexo adjunto (Ed. 13.14). 
  Por no haber sido posible practicar en el domicilio de sus destinatarios las notificaciones que se relacionan en el Anexo, se procede a su publicación en el BOLETÍN OFICIAL DE LA COMUNIDAD DE MADRID, a efectos de lo dispuesto en el artículo 59.5 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.
  Los expedientes relacionados en el Anexo indican los preceptos infringidos, correspondiendo estos a la Ley 16/1987, de 30 de julio, de Ordenación de los Transportes Terrestres (“Boletín Oficial del Estado” de 31 de julio).
  Contra dichas Resoluciones, que no agotan la vía administrativa, cabe interponer recurso de alzada ante el excelentísimo señor Consejero de Transportes, Infraestructuras y Vivienda, en el plazo de un mes a partir del día siguiente al de la publicación de la presente Resolución, sin perjuicio de que pueda ejercitar, en su caso, cualquier otro que estime procedente.
  En aquellos expedientes en que no se haya optado por la terminación anticipada y, por tanto, no se haya procedido al pago de la sanción, el importe deberá abonarse en el plazo de los quince días hábiles siguientes al que adquieran ejecutividad las resoluciones publicadas, por ingreso directo o transferencia en la cuenta corriente de la Comunidad de Madrid, Consejería de Transportes, Infraestructuras y Vivienda, Dirección General de Transportes 2038-1808-48-6000482302 de “Bankia” (calle de Sor Ángela de la Cruz, número 17), haciéndose constar el número de expediente y la identificación del interesado.
  En caso de no efectuarse el abono de la sanción, se procederá al cobro de la misma por vía ejecutiva, con arreglo a lo dispuesto en el Reglamento General de Recaudación.
  Los datos personales recogidos serán incorporados y tratados en los ficheros SANC y SAIN, cuya finalidad es la gestión informatizada de expedientes sancionadores en materia de transportes que tengan su origen en boletines de denuncia y actas de inspección, respectivamente, los cuales figuran inscritos en el Registro de Fichero de Datos Personales de la Agencia de Protección de Datos de la Comunidad de Madrid y podrán ser cedidos al Registro General de Transportistas y de Empresas de Actividades Auxiliares y Complementarias del Ministerio de Fomento, así como a otras Administraciones Públicas, en función de sus competencias materiales, de acuerdo con lo previsto en la Ley 16/1987, de 30 de julio, de Ordenación de los Transportes Terrestres, además de otras cesiones previstas en la Ley. El órgano responsable del fichero es la Dirección General de Transportes, y la dirección donde el interesado podrá ejercer los derechos de acceso, rectificación, cancelación y oposición ante el mismo es la calle Orense, número 60, 28020 Madrid, de todo lo cual se informa en cumplimiento del artículo 5 de la Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal.
